Overview

We are committed to protecting your privacy and developing technology that gives you a secure online experience. This Privacy Statement applies to the HOMEID® website (the “Site”) and other services provided by or through this Site. It does not apply to those sites, services and products that you may access from the Site, each of which may have its own privacy statements that differ materially from this Privacy Statement. By accessing and using the Site, downloading any materials from the Site, uploading any materials to the Site, or purchasing products or services from or through the Site, you acknowledge and fully understand this Privacy Statement and consent to the information collection and use practices described herein. If you do not agree to this Privacy Statement, do not use the Site, download any materials, upload any materials or purchase products or services.

By using the Site, you acknowledge and agree that you are either: (i) an original homeowner who was assigned a specific HOMEID account as a service to you by the builder of your home and/or your insurance provider; or (ii) a subsequent purchaser of a home, who has created their own HOMEID account, and has received certain information and materials pertaining to the home from an original homeowner, or its successor, via the Moving Van feature; or (iii) a user of the Site who has created its own HOMEID account to maintain and organize home-related documents, photos and information. The Site is owned, operated and maintained by HomeID, LLC, a Delaware limited liability company (the “Company”, “we”, “us”, “our”), as a service to allow (i) the builder to share with you photos taken during the course of construction of your home, floor plans, warranty manuals, owner manuals and other information related to your home, or (ii) your insurance provider to share with you reports related to your home, or (iii) you, the homeowner, to maintain and organize your own documents, photos and information related to your home. If you were assigned your HOMEID account by the builder of your home, after escrow has closed the builder may continue to use the Site to send out newsletters, updates to manuals or alert you of product recalls. The information shared with you by the builder and/or insurance provider is strictly in the sole discretion of the builder and/or insurance provider. You acknowledge and agree that the Company, its affiliates, subsidiaries, members, directors, officers, employees, successors and assigns shall have no obligation or responsibility whatsoever for the content or sharing of information with you by the builder and/or insurance provider.

You may elect to upload your own personal documents, which may include home maintenance records, plans and permits from a remodeling project, or a home inventory which would be easily accessed in the event of an insurance claim. If you sell your home in the future, you may (i) download certain documents or otherwise obtain copies of photos and other information relating to your property that you may physically deliver to the purchaser, or (ii) identify certain documents, photos and information relating to the property via the Moving Van feature, which will then be copied to a separate account to which the purchaser will be granted access via their own personal HOMEID account (pre-existing or newly created). With the latter option, the documents, photos and information associated with the home you transferred will be archived and will be read-only and capable of being downloaded within your own HOMEID account. If you purchase another home or property, you will be able to add documents, photos and information about such new property to your existing HOMEID account. Your HOMEID account is a secure, password protected webpage. The builder and/or insurance provider shall only have access to the information they provide, and not to your personal documents. You acknowledge and agree that the Company, its affiliates, subsidiaries, members, managers, directors, officers, employees, successors and assigns shall have no obligation or responsibility for your personal documents uploaded to the Site, or for any information you choose to share with others, including subsequent owners of the home.


Collection of your Personal Information

In order to access some of our services, you will be asked to sign in with an e-mail address and/or log-in name and a password, which we refer to as your credentials. As part of creating your credentials, you may also be requested to provide questions and secret answers, which we use to help verify your identity and assist in resetting your password. Some services may require added security, and in these cases, you may be asked to create an additional security key. Finally, a unique ID number may be assigned to your credentials which will be used to identify your credentials and associated information.

We may also ask you to provide personal information, such as your e-mail address, name, home or work address or telephone number. If you purchase goods and services through the Site, we may also collect your personal financial information such as credit card information, related account and billing information, invoice related information and other data to process the order. We may also update such data should you grant us permission to bill you or your credit card for recurring charges. We may use the tools, software or services of third-party service providers, as identified on the Site, to process transactions on our behalf. Each of those third-party service providers have agreed to comply with this Privacy Statement and may have their own privacy policies, which you may review on their websites. All information of this nature is maintained by us in a secure database and transmitted using secure transmission encryption.

We may also collect demographic information, such as your ZIP code, age, gender, preferences, interests and favorites. We may collect information about your visit, including the pages you view, the links you click, and other actions taken in connection with the Site. We also collect certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses. This information is used by us for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Site.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data onto any public areas of the Site or through public message boards, this information may be viewed, collected and used by others. We encourage you to publish only information you are certain you want to be accessible to the public-at-large.

We encourage you to review the privacy statements of websites you choose to link to from the Site so that you can understand how those websites collect, use and share your information. We are not responsible for the privacy statements or other content on websites outside of the HOMEID website.


Use of your Personal Information

We collect and use your personal information to operate and improve the Site and deliver the services or carry out the transactions you have requested. These uses may include providing you with more effective customer service; making the Site or services easier to use by eliminating the need for you to repeatedly enter the same information; and performing research and analysis aimed at improving our products, services and technologies.

We also use your personal information to communicate with you. We may send certain mandatory service communications such as welcome letters, information on technical service issues, and security announcements. We may also inform you of other products or services available.

We do not sell, rent or lease our customer lists to third parties. We may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, we may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services, and they are required to maintain the confidentiality of your information.

We may keep track of the websites and pages our customers visit at the Site, or our affiliated websites, in order to determine what services are the most popular. This data is used to deliver customized content and advertising within the Site to customers whose behavior indicates that they are interested in a particular subject area.

We will disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with any applicable law, regulation, legal process or governmental request; (b) enforce our Terms of Use including investigations of potential violations thereof; (c) detect, prevent, or otherwise address fraud or security issues; or (d) protect against harm to the rights, property or safety of the Company, users, you or the public.


Use of Cookies

The Site uses "cookies" to enable you to sign in to our services and to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

The Site uses cookies to store your preferences and other information on your computer in order to save you time by eliminating the need to repeatedly enter the same information and to display your personalized content and appropriate advertising on your later visits to these sites. When you return to the Site, the information you previously provided can be retrieved, so you can easily use the features that you customized.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. We are committed to protecting the security of your personal information. In addition, our business practices are reviewed periodically for compliance with policies and procedures governing the security and confidentiality of our information.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential. Do not share this information with anyone. If you are sharing a computer with anyone you should always choose to log out before leaving a site or service to protect access to your information from subsequent users.


Children

This website does not provide services or products to children under the age of 18.


Merger, Sale or Bankruptcy

In the event the Company is acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used. In any of the circumstances described in this paragraph, the information will be subject to the privacy policy of the purchaser or assignee.
